After the hearing the arguments from both, the Jagan’s lawyers and CBI counsels, the court rejected the petition. It may be mentioned that Jagan had approached the court seeking relaxations in conditions that restricted his movement outside Hyderabad. However, the CBI opposed the petition fearing that Jagan might influence the case if allowed to move freely across the country.

The court said that YS Jagan Mohan Reddy cannot be booked for breach of trust (section 409) and also the Prevention of Corruption Act.

The CBI has named PC Act and IPC 409 in the fifth charge sheet filed in connection with the Dalmia Cements case. INN

The CBI special court heard the case through video conference. The other accused whose remand has been extended include Mopidevi Venkata Ramana and Nimmgadda Prasad in DA case, bureaucrat KV Brahmananda Reddy, Gali Janardhan Reddy, Srinivas Reddy Mehfuz Ali Khan in the OMC case and Sunil Reddy in the Emaar case.

Meanwhile, the court has exempted Roads and Buildings minister B Dharmana Prasada Rao from appearing before the court. However, Vijaysai Reddy and senior bureaucrat Manmohan Singh appeared before the court. INN

Though Dharmana resigned from the cabinet after being named in the charge-sheet, the government did not accept his papers and the cabinet took a decision not to prosecute him. The cabinet decision was, however, sent back by Governor ESL Narasimhan for reconsideration and the minister has been attending duties. INN

Uphelding the CBI’s contention that no permission was required from the government to prosecute them, the CBI court has directed Dharmana and Mopidevi to appear before it on January 31.

It may be mentioned that the State Cabinet had rejected the CBI’s request to sanction Dharmana’s prosecution. However, the same file has been rejected by Government ESL Narasimhan. Mopidevi Venkata Ramana has already been arrested by the CBI in the Vanpic segment of disproportionate assets case of YSR Congress party president Jaganmohan Reddy.

In the changed scenario, Chief Minister N Kiran Kumar Reddy is likely to accept the resignation of Dharmana Prasad Rao.
